1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "Subscriber") and Hexagon Digital LLC ("Hexa", "we", "us", or "our"), operating Hexa Business App and the website hexabusinessapp.com.

By downloading, installing, accessing, or using Hexa Business App on iOS, Android, or web, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately uninstall and discontinue using our applications.

2. Scope of Services & AI Functionality

Hexa Business App provides an all-in-one mobile and web platform designed for commercial operators, contractors, and small businesses in the United States, United Kingdom, and international territories. Services include:

• Omnichannel business messaging (WhatsApp Business API, SMS, voice dialer, and web chat).
• Hyper-local GPS Lead Radar and commercial inquiry discovery.
• Artificial intelligence automated customer response, appointment booking, and dispatching.
• Payment and deposit processing through third-party processors (such as Stripe).

Disclaimer: Our AI conversational assistants are automated tools designed to assist business communication. Hexa does not guarantee specific commercial revenues, lead conversion rates, or contractual closures.

4. User Account & Security

To access Hexa Business App, you must register an account with a valid email address and phone number. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@hexabusinessapp.com of any unauthorized security breach.

5. Subscriptions, Free Trials & Billing

• 14-Day Free Trial: New subscribers may be granted a 14-day free trial. Unless cancelled prior to expiration, your subscription will automatically convert to the chosen recurring paid tier.
• Recurring Billing: Paid subscriptions (Starter, Pro, Enterprise) bill automatically on a monthly or annual cycle. Fees are non-refundable except where required by applicable law.
• Cancellation: You may cancel your subscription at any time directly through the app settings or by contacting billing support. Your access will continue through the end of the current paid billing cycle.

6. Prohibited Activities

You agree not to use Hexa Business App to:

• Transmit unsolicited spam, abusive, defamatory, or unlawful communications.
• Impersonate any person, government entity, or licensed enterprise without authorization.
• Reverse engineer, decompile, or extract the source code of our mobile APKs, iOS builds, or proprietary AI models.
• Violate the terms of service of third-party platforms, including WhatsApp, Google Cloud, Apple, or Stripe.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UNITED STATES LAW, HEXAGON DIGITAL LLC, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR THIRD-PARTY CLAIMS ARISING FROM YOUR USE OF HEXA BUSINESS APP.

8. Governing Law & Dispute Resolution

These Terms shall be governed and interpreted under the commercial laws of the United States of America. Any dispute, claim, or controversy arising out of these Terms shall be resolved through confidential, binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
